Terms of Service

These Terms of Service (“Terms”) govern your use of GiftLetter, a service product provided by MeritWorks LLC. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use GiftLetter.

The service

GiftLetter helps you track the people and occasions that matter and assemble “care packages” — an AI-drafted letter plus a basket of suggested gifts. GiftLetter is an intelligence and sending layer. We are not a merchant of record: gift purchases happen on third-party retailer sites, and we may earn an affiliate commission when you buy through our links.

Your account

You must provide accurate information, keep your credentials secure, and be responsible for activity under your account. You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use GiftLetter.

Acceptable use

You agree to use GiftLetter lawfully and to respect the privacy of the people you add as recipients — only add and sync information you are entitled to use. You may not misuse the service, attempt to access it in unauthorized ways, infringe others’ rights, or use it to send harassing, deceptive, or unlawful content.

Connected accounts

When you connect Google or iCloud, you authorize GiftLetter to access the calendar and contact information described in our Privacy Policy, solely to provide the features you request. You can disconnect at any time from the Integrations page.

Membership and billing

GiftLetter is free to use; scheduling a send requires a paid membership. Paid plans are billed in advance on a recurring basis through Stripe and renew automatically until canceled. You can cancel anytime; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. Prices and plan features may change with notice.

Third-party gift listings

Some gift suggestions are sourced from third-party marketplaces through their APIs, including Etsy. Listings, prices, and availability are controlled by the respective marketplace and merchant — not GiftLetter — and any purchase is made on that marketplace’s site and subject to its own terms and policies. We retrieve listing data only through these marketplaces’ official APIs and in accordance with their terms of use.

The term ‘Etsy’ is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.

DISCLAIMER: This application is solely provided by MeritWorks LLC (the “Application Developer”). You acknowledge that Etsy, Inc. and its affiliates are not the Application Developer, do not provide the application service, and make no warranties of any kind with respect to the application or data accessed through it.

AI-generated content

Letters and gift suggestions are generated with the assistance of AI and may contain inaccuracies. You are responsible for reviewing anything GiftLetter drafts before you choose to send it.

Intellectual property

GiftLetter and its software, design, and content are owned by us and our licensors. You retain ownership of the content you create; you grant us the limited license needed to operate the service and deliver what you ask us to send on your behalf.

Disclaimers and liability

GiftLetter is provided “as is” without warranties of any kind. We do not guarantee delivery times of third-party merchants or carriers. To the fullest extent permitted by law, GiftLetter is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the twelve months before the claim.

Termination

You may stop using GiftLetter and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service and its users.

Changes

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, communicated to you directly. Continued use after changes take effect constitutes acceptance.
